Terms of Service

1. Who we are

These Terms of Service ("Terms") form a binding agreement between you and Emberframe ("we", "us", "our"), the operator of Emberframe (the "Service"). By accessing or using the Service you agree to these Terms. If you do not agree, do not use the Service.

2. The Service

Emberframe lets you assemble photo slideshows in your browser, preview them for free, and pay a one-time fee to download the rendered video file. Your photos are processed locally in your browser and are not uploaded to our servers.

3. Acceptable use

You agree not to use the Service to:

• break the law or infringe anyone's intellectual property or privacy rights;
• upload content depicting minors inappropriately, sexual content without consent, hate speech, harassment, or illegal material;
• commit fraud, abuse payment systems, or attempt unauthorized access;
• scrape, probe, or interfere with the Service or its underlying infrastructure;
• introduce malware, conduct denial-of-service attacks, or circumvent technical limits.

You are solely responsible for the photos, music, and other content you process with the Service and for ensuring you have all necessary rights to use them.

4. Intellectual property

We retain all rights, title, and interest in the Service, including its software, design, branding, and documentation. We grant you a limited, non-exclusive, non-transferable, revocable right to use the Service for its intended purpose. You retain ownership of the photos and content you bring to the Service. You grant us only the limited rights needed to operate the Service for you (which, given that processing happens in your browser, is minimal).

5. Payments and refunds

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment terms, billing, taxes, and currency conversion are governed by the Paddle Checkout Buyer Terms. Refunds are handled per our Refund Policy.

6. Service availability

The Service is provided "as is" and "as available". We do not guarantee that it will be uninterrupted, error-free, or meet your specific requirements. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

7. Suspension and termination

We may suspend or terminate your access to the Service if you breach these Terms, engage in fraud or abuse, fail to pay, or pose a security risk. You may stop using the Service at any time.

8. Limitation of liability

To the fullest extent permitted by law, our aggregate liability arising out of or relating to the Service is limited to the amount you paid to us in the 12 months preceding the claim. We are not liable for indirect, incidental, consequential, or special damages, including lost profits, lost data, or loss of goodwill. Nothing in these Terms limits liability for fraud, death, or personal injury where such limitation is prohibited by law.

9. Indemnity

You agree to indemnify and hold us harmless from any claims arising out of your content, your use of the Service, or your breach of these Terms.

10. Changes

We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date above. Continued use of the Service after a change constitutes acceptance.

11. Governing law

These Terms are governed by the laws of the jurisdiction in which we are established, without regard to conflict-of-laws rules. Disputes will be resolved in the competent courts of that jurisdiction.
